GDPR Policy

Purpose

The General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) is a regulation of the European Parliament, the Council of the European Union and the European Commission intended to strengthen and unify data protection for all individuals within the European Union (EU) and became law in the UK on 25th May 2018.

Under the General Data Protection Regulation (GDPR), we are required to publish information about what data we collect, why we need to store it, and your rights under the GDPR legislation.

In these matters we are subject to the rulings of the Information Commissioner’ Office (ICO), the UK’s independent authority set up to uphold information rights and data privacy for individuals.

  • Basis of and scope of data storage
    • We store and process data only as agreed by the learner or as required in order to perform services requested. We regard all details we do store as confidential.
    • We do not engage in any profiling activities.
    • We only share data with the Department for Work and Pensions and Smart Awards in order to register you and claim for your qualifications. 
    • The information that is required to be shred with other parties is protected by the GDPR process within that organisation, specific data handling information can be found on their website
  • How we obtain data:
    • Data we hold will consist solely of information that you provide to us (e.g. contact details you enter on forms or correspondence), or is determined through your direct interaction with our website (e.g. your IP address).
  • Data we hold consists of:
    • Contact information:
      • Your name. Postal address. Country. Email addresses. Telephone number, date of birth etc.
        This is used so that we can contact you and to register you for the qualifications you will be gaining.
      • Enquiries we have received via email, web-form or post.
    • We may also store your IP address for security reasons and to enable us to investigate technical problems if you experience a fault whilst using our site.
  • Retention policy:
    • We retain personal data that you supply for as long as you are a learner with an active account, and for as long as we are legally required to do so (e.g. for the DWP and for Audit purposes, which could be up to 5 years) 
    • General enquiries via web-form, email or post:
      • These are generally kept for a number of years so that we can refer back to them if you send a follow up to our reply, after that they are deleted: At scheduled times throughout the year enquiries over the specified number of years old are removed.

MULTI UTILITY SKILLS & TRAINING’s commitment

Every employee is entitled to a working environment that promotes dignity, equality and respect for all. MULTI UTILITY SKILLS & TRAINING will not tolerate any acts of unlawful or unfair discrimination (including harassment) committed against any learner because of a protected characteristic:

  • sex;
  • gender reassignment;
  • marriage and civil partnership;
  • pregnancy and maternity;
  • race (including ethnic origin, colour, nationality and national origin);
  • disability;
  • sexual orientation;
  • religion and or belief; and
  •  

 

No form of intimidation, bullying or harassment will be tolerated. If you believe that you may have suffered discrimination because of any of the above protected characteristics, you should consider the appropriateness and feasibility of attempted informal resolution by discussion in the first instance with your tutor or another member of staff in a relevant position of seniority. Allegations regarding potential breaches of this policy will be treated in confidence and investigated in accordance with the appropriate procedure. MULTI UTILITY SKILLS & TRAINING will ensure that individuals who make such allegations in good faith will not be victimised or treated less favourably by MULTI UTILITY SKILLS & TRAINING as a result. However, false allegations of a breach of this policy which are found to have been made in bad faith will be dealt with accordingly.

When does this policy apply?

This policy applies to all conduct in the training centre and also to conduct outside of the centre that is related to your training.

MULTI UTILITY SKILLS & TRAINING’s legal duties

As a public body, MULTI UTILITY SKILLS & TRAINING’s is additionally subject to public sector equality duties under the Equality Act 2010. This policy will be reviewed on an ongoing basis by MULTI UTILITY SKILLS & TRAINING to assess its effectiveness and may be amended from time to time.

The main types are:

  • Direct discrimination Direct discrimination occurs where one person is treated less favourably than another because of a protected characteristic set out in this policy. Other types of direct discrimination are:
  • Associative discrimination – this is direct discrimination against someone because they associate with another person who possesses a protected characteristic.
  • Perceptive discrimination – this is direct discrimination against an individual because others think they possess a particular protected characteristic.

2) Indirect discrimination – Indirect discrimination occurs when an unjustifiable requirement or condition is applied, which appears to be the same for all, but which has a disproportionate, adverse effect on one group of people. This is discrimination even though there was no intention to discriminate. For example, a requirement for UK based qualifications could disadvantage applicants who have obtained their qualifications outside of the UK; this could amount to indirect discrimination on the grounds of race.

3) Victimisation – Victimisation is where an learner is treated less favourably than others because they have asserted legal rights against MULTI UTILITY SKILLS & TRAINING.

4) Harassment – Harassment is “unwanted conduct related to a relevant protected characteristic, which has the purpose or effect of violating an individual’s dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment for that individual.” It is important to remember that it is not the intention of the harasser but how the recipient perceives their behaviour, which determines whether harassment has occurred.

Reasonable Adjustment

It is company policy not to disadvantage any persons from work within the business providing that for health and safety reasons (either physiological or psychological) it would not be appropriate because of the danger to themselves, work colleagues or other.

Reasonable arrangements/modifications, where practical, will be carried out to allow a disabled person the opportunity of work, and to the extent of modification required by legislation to accommodate disabled employees.

Employment will be considered on a case-by-case basis taking into consideration disability and the type and environments of the work required to be carried out. A major consideration will be the ability to work safely both to themselves and others. There is no intent to infringe the human rights of any person disabled or otherwise.

For example, if a learner states they are dyslexic, overlays in the colour that is best for them will be provided. If a learner needs a scribe, we will not discriminate and within reason will endeavour to make this happen to ease their learning. Multi Utility Skills & Training will meet all needs on a case-by-case basis, and we will make reasonable adjustments for the learner.

All reasonable adjustments Multi Utility Skills & Training make will be logged and recorded and all measures put in place must meet the specified accreditation and qualification code of practice.

Assessment, Invigilator and IQA Policy

This MULTI UTILITY SKILLS & TRAINING policy is approved by the ULTI UTILITY SKILLS & TRAINING board; it represents the ULTI UTILITY SKILLS & TRAINING board’s direction to the business of this topic. Compliance with this policy is mandatory through aligning ULTI UTILITY SKILLS & TRAINING Management system processes and people behaviours to the commitments below.

All qualified assessors (or those working towards) will assess using the awarding bodies assessment materials specified as valid, authentic, reliable, current, and sufficient.

All assessors will work to the current EUSR assessment strategy (this has been issued and signed for by all assessors and IQA).

All assessors will, if needed, work towards the CITB Consolidated assessment strategy (this has been issued to all assessors and IQA).

All assessors will, if needed review assessment environments in line with the current centre handbooks, of which will depend on the qualification in question.

Al invigilation will be carried out by a nominated and qualified invigilator in accordance with the awarding body’s requirements. The selected individual must at least hold so-called ‘invigilator training’, which comprises a brief but common course sat online, culminating in an assessment to gauge knowledge. Other suitable candidates to invigilate exams and maintain a neutral and distraction-free environment include tutors/assessors or even a teaching assistant.

With invigilation, EUSR, CITB and other affiliated awarding bodies have their own specific invigilation checklist that must be completed for each exam, covering the number of attendees, the exam environment and instances of malpractice or foul play.

All IQAs will judge the validity of the assessor’s assessment decisions based upon the awarding bodies assessment requirement i.e. valid, authentic, reliable, current and sufficient.

This will be recorded on all IQA reports and will form the basis of the IQA question (on the IQA report) that states “Does the IQA agree with the assessor’s decision?”

Safeguarding Policy

Safeguarding

This policy seeks to ensure that MULTI UTILITY SKILLS & TRAINING undertakes its responsibilities regarding the protection of potentially vulnerable adults, including the unemployed, and will respond to concerns appropriately. The policy establishes a framework to support paid and unpaid staff in their practices and clarifies the organisations expectations.

Although Multi Utility Skills & Training does not employ children for work experience, whilst under training, the young person will be under competent supervision and mentoring from a qualified member of staff.

If you have any safeguarding issues, these should be directed to senior members of staff and/or the Director Scott Johnson.

Prevent

Prevent is part of the government’s counter-terrorism strategy. It aims to prevent people from being radicalised.

We have a responsibility under the Counter Terrorism Act 2015 to help stop people becoming drawn into or supporting terrorism.

As a training provider Multi Utility Skills & has a responsibility to ensure that:

  • Training is provided to all parties on their Prevent Duty
  • Leaders and Managers ensure that adequate training and resources are in place to meet obligations.
  • Staff know when it is appropriate to refer concerns about learners or other members of staff to a DSO or the DSL
  • We also have a responsibility to exemplify Fundamental British Values of Democracy, The Rule of Law, Individual Liberty and mutual respect.

If a learner has concerns about themselves, or you have concerns about a learner and the possibility that they are at risk of being radicalised, you should follow the same practice for referring safeguarding concerns.

Please note: If you feel that a learner, yourself or any other party are in imminent danger, you must report this to the police.

Complaints Policy

This Complaints Policy covers how MULTI UTILITY SKILLS & TRAINING manages complaints received from its customers and learners.

A customer is an organisation or individual using any of the services Multi Utility Skills & Training provides. This includes but is not limited to, learners enrolled on programmes/courses, apprentices or trainees.

Complaint Procedure

A complaint is identified when a customer expresses any dissatisfaction regarding any of the services provided by MULTI UTILITY SKILLS & TRAINING.

MULTI UTILITY SKILLS & TRAINING takes all complaints very seriously and with extreme confidentiality. Therefore, we are committed to responding to any type of complaint made directly to MULTI UTILITY SKILLS & TRAINING withing 5 working days of receiving the complaint and we will reach a decision withing 20 working days.

Raising a complaint

MULTI UTILITY SKILLS & TRAINING encourage any customers who are dissatisfied with our services to bring this to our attention as soon as possible.

In the first instance and if possible, a complaint should first be raised with personnel on a local level e.g with the course tutor or supervisor. If this is not possible this should be directed to the Management Team.

You can also make a complaint in writing directly to MULTI UTILITY SKILLS & TRAINING, this should be done to the following address.

When making a complaint in writing the customer should provide their full name and contact details, while also providing a full description of the complaint, including the subject matter, dates and times if known, and any other persons who has been dealing with the complaint. Also including any letters or documents relating to the complaint.

 

if you remain unhappy after following our own internal complaints procedure and your complaint refers to services you have received relating to your course and achieving your qualification then please contact the Awarding Organisation directly.

EUSR will write to you regarding their final position within 28 days of receiving a complaint.

 

Should you address your complaint to EUSR and remain unhappy with the outcome you may then raise your complaint to the relevant qualification regulator. Either a representative of Multi Utility Skills & Training or EUSR will be able to offer you guidance on the appropriate qualification regulator in each instance and provide contact details.

 

All customer business or personal information gathered and/or held during the submission and investigation of the complaint to MULTI UTILITY SKILLS & TRAINING will be kept in strict confidence. No information will be released to a third party in a format that will allow identification, except with the express consent of the individual making the complaint, or as required by the law.

Multi Utility Skills & Training is committed to providing an accessible and inclusive workplace to enable people with disabilities to participate fully in all aspects of training.

  • the location and timing of the assessment
  • the format, wording or type of assessment activity
  • the availability of support personnel for additional needs

  • any circumstances outside of the learner’s control, bereavement, personal illness, accidents.
  • Part of an assessment is missed due to circumstances outside of the learner’s control.
